2. Scope of application

These General Terms and Conditions of Sale (GTC) govern distance sales contracts concluded through the website www.essentiapuglia.com between Essentia Puglia and the Customer, in compliance with current legislation, in particular:

Legislative Decree no. 206/2005 (Consumer Code), arts. 50–67 – Distance contracts
Legislative Decree no. 70/2003 – E-commerce
Directive 2011/83/EU, transposed by Legislative Decree 21/2014
EU Regulation 2016/679 (GDPR)
EC Regulation no. 1223/2009 – Cosmetic products

By placing an order, the Customer declares to have read, understood and fully accepted these GTC. The applicable GTC are those in force at the time of order submission.

3. Products and offer

The products presented on the Website constitute a public offer pursuant to article 1336 of the Italian Civil Code. Essentia Puglia reserves the right to modify the catalog and prices at any time, without prior notice. Any changes do not apply to orders already confirmed.

The cosmetic products marketed by Essentia Puglia comply with EC Regulation no. 1223/2009. Information on ingredients (INCI) is available on the packaging and, where possible, in the product sheets on the Website.

Product images are for illustrative purposes only; any color differences compared to the physical product may depend on the Customer's monitor settings.

4. Prices

All prices indicated on the Website are expressed in Euro (€) and include VAT, unless otherwise stated. Shipping costs are not included in the price and are indicated separately at checkout, before order confirmation.

5. Shipping costs

The shipping costs applicable for orders destined for Italy are as follows:

Any amount – Cash on delivery	Shipping cost + € 5.00 surcharge incl. VAT

For shipments to the Euro Area or outside the EU, rates vary according to the destination country and are indicated at checkout. Any customs duties for non-EU shipments are borne by the Customer.

6. Order procedure

To place a purchase, the Customer must:

Browse the catalog and add desired products to the cart
Proceed to checkout and provide shipping and payment details
Verify the order summary (products, quantity, prices, shipping costs)
Accept these GTC and confirm the order

The order is considered perfected upon the Customer's receipt of the order confirmation email. Essentia Puglia reserves the right to refuse or cancel orders in case of: obvious price errors on the Website, product unavailability, unpaid previous invoices, suspected fraudulent use. In such cases, the Customer will be promptly informed and fully reimbursed.

7. Payment methods

The Website accepts the following payment methods:

Credit/debit card (Visa, Mastercard, American Express) – via secure gateway
PayPal – Essentia Puglia is a Verified PayPal User
Advance bank transfer – shipment takes place upon receipt of credit
Cash on delivery (payment upon delivery) – where available, with a surcharge of € 5.00 incl. VAT

All online transactions take place via encrypted connection (SSL). Essentia Puglia does not store sensitive payment data.

8. Delivery

Products are delivered to the address indicated by the Customer during the order process. The indicated delivery times (72 working hours) are purely indicative and start from the shipment of the package. Upon delivery, the Customer is required to:

Verify the integrity of the packaging and its correspondence with the order
Immediately report any damage or anomalies to the courier, signing the delivery document with reservation
Communicate any problems to Essentia Puglia within 3 days of receipt via email to info@essentiapuglia.com

9. Legal guarantee of conformity

For Consumers, the legal guarantee of conformity applies pursuant to articles 128–135 of the Consumer Code and Legislative Decree 170/2021. In case of a lack of conformity, the Customer has the right to restoration of conformity, replacement, or refund. To report a defect: info@essentiapuglia.com

10. Right of withdrawal

The Consumer Customer has the right to withdraw from the contract without providing any reason within 14 (fourteen) calendar days from the date on which they acquire physical possession of the goods, pursuant to article 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

How to exercise withdrawal

Withdrawal can be communicated via:

The Customer may use the standard withdrawal form at the bottom of this page (Annex A).

Return of products

After communicating withdrawal, the Customer must return the products within 14 calendar days. Return costs are borne by the Customer, unless the product is defective or non-conforming. Products must be returned intact, in their original packaging, complete with all accessories.

Refund

Essentia Puglia will refund the price of the products and the standard shipping costs incurred by the Customer within 14 calendar days of receiving the withdrawal communication, or from receiving the returned products (if later). The refund will be made using the same payment method used by the Customer. For cash on delivery payments, the refund will be made via bank transfer.

Exceptions to the right of withdrawal

The right of withdrawal does not apply, pursuant to article 59 of the Consumer Code, to:

Sealed products which are not suitable for return for health protection or hygiene reasons and were unsealed after delivery (e.g. perfumes, cosmetics with open seals)
Products made to specification or clearly personalized

11. Alternative dispute resolution (ADR/ODR)

Netcomm Joint Conciliation

If the complaint sent to Essentia Puglia has not been satisfactorily resolved within 30 days, the Customer can initiate the Netcomm Joint Conciliation procedure by sending the application to: conciliazione@consorzionetcomm.it or fax: 02.87181126.

ODR Platform – Mandatory by law (EU Regulation 524/2013)

12. Force majeure

Essentia Puglia is not responsible for delays or failures caused by events beyond its reasonable control, including strikes, epidemics, natural disasters, communication network interruptions, or other extraordinary events.

13. Processing of personal data

The Customer's personal data are processed by Essentia Puglia as Data Controller pursuant to EU Regulation 2016/679 (GDPR). For detailed information, please refer to the Privacy Policy available on the Website.

14. Applicable law and competent court

These GTC are governed by Italian law. For Consumers resident in the EU, the protective legislation of their country of residence also applies, if more favorable. For any dispute, the competent court is that of the Consumer's place of residence or domicile. For non-Consumer customers, the exclusive competent court is Brindisi.
